WHAT YOU SHOULD KNOW
ABOUT LITIGATION IN DOMINICAN REPUBLIC

You should be aware that, in Dominican Republic, as in other jurisdictions, the process to obtain a court ruling in any claim may take a considerable amount of time. Litigious proceedings are divided into two degrees of ordinary jurisdiction, the first instance and then an appeal level, where both the facts and the law are heard and one degree of extraordinary jurisdiction before the Supreme Court of Justice, concerned only with the proper application of the law.

 

The first degree of ordinary jurisdiction is held before a civil and commercial judge while the second degree is held before a civil chamber composed of five regular judges. Access to the Supreme Court of Justice is limited based on certain requirements pertaining to the amounts and the type of dispute involved.

 

Remember, in order to better assist us in this process, we will require that you stop any communications with the counterpart or their representatives and refer any communications to us. It is not uncommon for other Lawyers to disregard rules of ethics by communicating directly with the opposite party without their lawyer participating.
